(IOA) signed by Maharaja Hari Singh, to accede to India, was legally valid.
The IOA was accepted under

The Maharaja was not a popular leader, and was regarded as a tyrant by most Kashmiris as he used

Indian forces were in Kashmir before the Instrument of Accession was signed with India. That is a violation of the
, which was designed to prevent the application of coercion on the ruler of Kashmir.
This argument of The Instrument of Accession is no longer valuable as the will of the people must now be catered to.
